1. Acceptance of Terms

By creating an account or using this service, you agree to these Terms of Service. If you do not agree, you may stop using the service at any time.

2. Description of the Service

This service analyzes photo albums, detects bib numbers, and writes metadata such as keywords to your images. The service does not modify, delete, or alter the image files themselves.

By connecting your SmugMug account, you authorize this service to read your album and image data and to write keywords and metadata on your behalf.

Album selection. The service presents up to 200 albums from your SmugMug account for you to choose from. Not every album in your account may be available in the picker. Older galleries, albums beyond that limit, or albums that SmugMug exposes only in certain folder layouts may be unavailable. The service is intended primarily for recently captured event photography. We do not warrant that any specific album will appear or be processable.

3. No Guarantee of Accuracy

Scan results are generated by automated systems and may contain errors, omissions, or incorrect detections. No accuracy, completeness, or correctness is guaranteed. Users are responsible for reviewing and confirming all results before use.

4. Metadata and Keyword Writing

The service may write or update metadata fields (such as keywords) on your images. While the service does not delete or overwrite the image files themselves, metadata may be incorrect, incomplete, or undesired.

If you choose not to use the tracking keywords RP_TAG and RP_TAG_E, the service may not be able to identify or remove metadata it previously wrote.

If you select "Replace all keywords," all existing keywords on your images will be overwritten and cannot be recovered through this service. You are responsible for backing up important keywords before using this option.

5. Scan Records and Storage Limits

The service stores up to 100 scan records per user. This limit applies only to stored history, not to how many albums you may scan.

  • Older records may be automatically or manually removed to free space.
  • If a record is removed, the album must be rescanned to apply new tagging rules or updated detection technology.
  • Stored albums (up to 100) may be reprocessed with improved engines in the future.

In rare cases, scan credits or stored balances may be lost due to data corruption or system failure. While this is highly unlikely, the service does not guarantee preservation of credit balances or scan history.

Upon account termination or deletion, stored scan data may be permanently removed.

6. User Responsibilities

You represent and warrant that:

  • You have the rights or permissions to process all images accessed through this service.
  • You will not grant this service access to illegal, harmful, or unauthorized content.
  • You will comply with all applicable privacy and data-protection laws when processing images containing people.

You are responsible for reviewing scan results and ensuring they meet your needs.

7. Payment, Credits, and Refunds

Credits or payments made for scanning are non-refundable unless required by law. If scan records are lost or purged, rescanning may require additional credits.

8. Third-Party Services

This service depends on third-party platforms such as SmugMug. We are not responsible for outages, API changes, or access issues caused by third-party services. Changes to third-party platforms may affect the availability or functionality of this service without prior notice.

9. Service Changes and Availability

The service may change, suspend, or discontinue features at any time. Detection models and tagging engines may be updated periodically, but older albums without stored scan data will not automatically receive updated processing.

10. Limitation of Liability

To the fullest extent permitted by law:

  • The service is provided "as is" and "as available."
  • The service is not liable for:
    • incorrect or missing detections
    • metadata errors or keyword loss
    • lost scan records or credit balances
    • indirect, incidental, or consequential damages
    • lost revenue or missed sales opportunities

Your sole remedy for dissatisfaction with the service is to stop using it.

11. Intellectual Property

All software, algorithms, and service components are owned by the service provider. You retain ownership of all images and content you process through this service.

12. Reverse Engineering

Users may not copy, modify, decompile, disassemble, analyze, or otherwise attempt to access or derive the source code, algorithms, models, or internal workings of this service. Any attempt to reverse engineer or replicate the technology is strictly prohibited and may result in immediate termination of the account without any credit or refund.

13. Minimum Age

You must be at least 18 years of age to create an account or use this service.

14. Termination

We may suspend or terminate accounts that violate these terms or misuse the service. You may stop using the service at any time. Upon termination, stored scan data and account information may be permanently deleted.

15. Privacy

Information about how data is collected, stored, and used is described in the Privacy Policy.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to conflict of law principles.

17. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the service or by email. Continued use of the service constitutes acceptance of the updated Terms.
